4. Scope of data protection

The subject matter of data protection is personal data. According to the Federal Data Protection Act (BDSG), personal data comprises all individual details relating to the personal or factual circumstances of an identified or identifiable natural person. The GDPR further defines ‘personal data’ as any information relating to an identified or identifiable natural person; a natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data or an online identifier. A data subject is any identified or identifiable natural person whose personal data is processed by the controller. Processing means any operation or set of operations which is carried out on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, distribution or any other form of disclosure, the matching or linking, the restriction, erasure or destruction.

5. General information on data processing

5.1 Scope of the processing of personal data

As a general rule, we collect and use our users’ personal data only to the extent necessary to provide a fully functional website and to deliver our content and services. The collection and use of our users’ personal data generally takes place only where permitted by law or on the basis of consent.

5.2 Legal basis for the processing of personal data

Where we obtain the data subject’s consent for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations necessary for the implementation of pre-contractual measures. Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) of the GDPR serves as the legal basis. Where the processing of personal data is necessary to protect the vital interests of the data subject or of another natural person, Article 6(1)(d) of the GDPR serves as the legal basis. Where processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Article 6(1)(f) of the GDPR serves as the legal basis for the processing.

5.3 Data erasure and retention period

The data subject’s personal data shall be erased or restricted as soon as it is no longer required for the purpose for which it was stored. Data may also be stored if this is provided for by European or national legislation in EU regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted when a retention period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the conclusion or performance of a contract.

5.4 Disclosure of personal data

Your personal data will be used, without your separate consent, solely for the purpose of establishing, performing or terminating a contractual or quasi-contractual obligation, or for the fulfilment of our obligations under public law. Where you have provided us with a separate declaration of consent for the use and disclosure of your personal data, your personal data may also be disclosed to the recipients specified therein. Should personal data be disclosed to service providers in the context of data processing on our behalf, these service providers are also bound by the GDPR / BDSG and other applicable legal provisions. Data processing, which is carried out exclusively in accordance with our instructions, is ensured by entering into data processing agreements that comply with the requirements of the GDPR. No further disclosure of customers’ personal data to third parties will take place. Where we are obliged to do so by law, by court order or pursuant to an enforceable official directive, we will disclose your personal data to authorities entitled to receive such information. Furthermore, we will disclose your personal data to third parties if such disclosure is necessary to enforce existing agreements or our rights and claims arising from contractual obligations with you, or to protect the rights of other users and/or third parties.

6. Collection of data when visiting the website

6.1 Scope of the processing of personal data

This website collects a range of general data and information each time a data subject or an automated system accesses a web page.

  • The following data is collected in this process:
  • Information about the browser type and version used
  • The user’s operating system
  • The user’s internet service provider
  • The user’s IP address
  • Date and time of access
  • Websites from which the user’s system accesses our website
  • Websites accessed by the user’s system via our website
  • Search terms entered
  • Frequency of page views
  • Language settings

6.2 Purpose of data processing

This general data and information is stored in the web server’s log files. The data collected may include the types and versions of browsers used, the operating system used by the accessing system, the website from which an accessing system reaches our website (known as a ‘referrer’), the sub-pages on our website accessed via the accessing system, the date and time of access to the website, an Internet Protocol address (IP address), the Internet service provider of the accessing system, and other similar data and information used for security purposes in the event of attacks on our information technology systems. No conclusions regarding the data subject are drawn from the use of this general data and information. Rather, this information is required in order to deliver the content of our website correctly, to optimise the website’s content for users, to ensure the ongoing functionality of our IT systems and website technology, and to provide law enforcement agencies with the information necessary for criminal prosecution in the event of a cyber-attack. This collected data and information is therefore analysed, on the one hand, for statistical purposes and, on the other, with the aim of enhancing data protection and data security within the company, ultimately to ensure an optimal level of protection for the personal data being processed. The anonymous data from the server log files is stored separately from any personal data provided by a data subject.

6.3 Duration of storage

6.3 Duration of storage: The data is pseudonymised following statistical analysis. Where data is stored in log files, this takes place after 30 days at the latest. Storage beyond this period is possible. In such cases, users’ IP addresses are deleted or anonymised so that it is no longer possible to identify the client making the request.

6.4 Legal basis

The legal basis for the temporary storage of data and log files is Article 6(1)(f) of the GDPR.

6.5 Right to object and right to have data erased

The collection of data for the purpose of providing the website and the storage of this data in log files is essential for the operation of the website. Consequently, users have no right to object.

7. Use of cookies

7.1 Description and scope of data processing

Our website uses cookies. Cookies are text files that are stored in, or by, the web browser on the user’s computer system. When a user visits a website, a cookie may be stored on the user’s operating system. This cookie contains a distinctive string of characters that enables the browser to be uniquely identified when the website is visited again.

We use cookies to make our website more user-friendly. Some elements of our website require that the browser used to access the site can be identified even after a page has been changed. The following data is stored and transmitted via the cookies:

  • Language settings
  • Information on whether the quick booking form is expanded
  • Session cookie (for the duration of the browser session) to temporarily store filter selections made or details entered in completed forms

We also use cookies on our website that enable us to analyse users’ browsing behaviour. In this way, the following data may be transmitted:

  • Information about the browser type and version used
  • The user’s operating system
  • The user’s internet service provider

  • Websites from which the user’s system accesses our website
  • Websites accessed by the user’s system via our website
  • Search terms entered
  • Information about the type of device used
  • Language settings
  • Frequency of page views
  • Location

The user data collected in this way is pseudonymised by technical means. Consequently, it is no longer possible to link the data to the user who accessed the site. The data is not stored together with any other personal data relating to users. When accessing our website, users are informed via an information banner about the use of cookies for analytical purposes and are directed to this privacy policy. In this context, there is also a note on how the storage of cookies can be prevented in the browser settings. If, after our notice regarding the use of cookies and the analysis of your user behaviour has appeared on our homepage, you (i) use our online service and (ii) have enabled the acceptance of cookies in your browser settings, this indicates to us that you wish to use our products and services and, in doing so, consent to the use of cookies, services and other technologies.

7.2 Legal Basis for Data Processing

The legal basis for the processing of personal data through the use of technically necessary cookies is Article 6(1)(f) GDPR. Where the user has given the relevant consent, the legal basis for the processing of personal data through the use of cookies for analytical purposes is Article 6(1)(a) GDPR.

7.3 Purpose of Data Processing

Technically necessary cookies are used to make websites easier for users to use. Some functions of our website cannot be provided without the use of cookies. These functions require the browser to be recognised again after the user changes pages.

We require cookies for the following applications: a session cookie, stored for the duration of the browser session, which temporarily stores selected filters or information entered in completed forms. User data collected through technically necessary cookies is not used to create user profiles.

Analytical cookies are used to improve the quality of our website and its content. Analytical cookies enable us to understand how the website is used and to continuously optimise our services. These purposes also constitute our legitimate interest in processing personal data pursuant to Article 6(1)(f) GDPR.

7.4 Storage Period, Right to Object and Options for Removal

Cookies are stored on the user’s device and transmitted from it to our website. As a user, you therefore have full control over the use of cookies. By changing the settings in your internet browser, you can disable or restrict the transmission of cookies. Cookies that have already been stored can be deleted at any time. This can also be done automatically.

If cookies are disabled for our website, it may no longer be possible to use all of the website’s functions in full.

Most browsers, such as Firefox, Chrome, Internet Explorer and Safari, accept cookies by default. However, you can configure your browser so that you are informed when cookies are set and can decide individually whether to accept them, or so that cookies are rejected in certain cases or in general.

The help pages of most browsers explain how to configure your browser as described above. They also generally explain how to make your browser notify you when a new cookie is received and how to disable or delete all cookies received.

Similar functions, such as Flash cookies, that are used by browser add-ons can be disabled or deleted by changing the settings of the relevant browser add-on or by visiting the website of the browser add-on provider.

However, we expressly point out that certain features of our website may no longer be available and some webpages may not be displayed correctly if you disable cookies.

11. Further Privacy Information on the Use of Social Media and Plugins

When you access a page of our website that contains such a plugin, your browser establishes a direct connection to the servers of the relevant service. The content of the plugin is transmitted directly to your browser by the respective provider and integrated into the page.

We therefore have no influence over the scope of the data collected by plugin providers through these plugins and inform users according to our current level of knowledge.

By integrating the plugins, the providers receive the information that your browser has accessed the corresponding page of our website, even if you do not have a profile or are not currently logged in.

This information, including your IP address, is transmitted directly from your browser to a server operated by the respective provider, potentially in the United States, and stored there.

If you are logged in to one of the services, the provider may directly associate your visit to our website with your profile on the relevant service.

If you interact with a plugin, for example by clicking the “Like” button, the corresponding information is also transmitted directly to a server operated by the provider and stored there. The information may also be published on the social network or in your account and displayed to your contacts.

For information about the purpose and scope of data collection, the further processing and use of the data by the providers, your related rights and the settings available to protect your privacy, please refer to the respective providers’ privacy policies.

12. Use of Google Analytics

We have integrated the Google Analytics component into this website. Google Analytics is a web analytics service.

Web analytics involves the collection and evaluation of data concerning the behaviour of visitors to websites. A web analytics service records, among other things, the website from which a data subject reached another website, known as the referrer, the subpages of the website that were accessed, how frequently a subpage was viewed and how long it was viewed.

Web analytics is mainly used to optimise a website and to perform cost-benefit analyses of online advertising.

The operator of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

For web analytics through Google Analytics, the controller uses the “_gat._anonymizeIp” function. This function causes Google to shorten and anonymise the IP address of the data subject’s internet connection when our website is accessed from a Member State of the European Union or another state that is party to the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyse visitor traffic on our website. Google uses the data and information collected, among other things, to evaluate the use of our website, compile online reports for us that show activity on our website and provide other services related to the use of our website.

Google Analytics places a cookie on the data subject’s information technology system. Cookies have already been explained above. Setting the cookie enables Google to analyse the use of our website.

Each time an individual page of this website operated by the controller and containing an integrated Google Analytics component is accessed, the relevant Google Analytics component automatically causes the browser on the data subject’s information technology system to transmit data to Google for online analysis.

As part of this technical process, Google obtains knowledge of personal data, such as the data subject’s IP address, which Google uses, among other things, to trace the origin of visitors and clicks and subsequently facilitate commission settlements.

The cookie stores personal information such as the time of access, the location from which access originated and the frequency with which the data subject visits our website.

Each time our website is visited, this personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America.

Google may disclose personal data collected through this technical process to third parties.

As described above, the data subject can prevent cookies from being set by our website at any time by selecting the appropriate settings in the internet browser used and can therefore permanently object to the setting of cookies.

Such a browser setting would also prevent Google from placing a cookie on the data subject’s information technology system. A cookie already placed by Google Analytics can also be deleted at any time through the internet browser or other software programs.

The data subject also has the option of objecting to and preventing the collection of data generated by Google Analytics relating to the use of this website and the processing of such data by Google.

To do so, the data subject must download and install the browser add-on available at:

https://tools.google.com/dlpage/gaoptout

This browser add-on uses JavaScript to inform Google Analytics that no data or information concerning visits to websites may be transmitted to Google Analytics. Google treats the installation of the browser add-on as an objection.

If the data subject’s information technology system is subsequently deleted, formatted or reinstalled, the data subject must reinstall the browser add-on in order to disable Google Analytics.

If the browser add-on is uninstalled or disabled by the data subject or another person within the data subject’s sphere of control, the browser add-on can be reinstalled or reactivated.

Further information and Google’s applicable privacy policies are available at:

https://www.google.de/intl/de/policies/privacy/

https://www.google.com/analytics/terms/de.html

Google Analytics is explained in more detail at:

https://www.google.com/intl/de_de/analytics/

12.1 Use of Facebook

The website uses social plugins, hereinafter referred to as “plugins”, from the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA, hereinafter referred to as “Facebook”.

The plugins can be identified by one of the Facebook logos, such as a white “f” on a blue tile or a thumbs-up symbol, or by the wording “Facebook Social Plugin”.

A list of the Facebook social plugins and examples of their appearance can be viewed at:

https://developers.facebook.com/docs/plugins/

When a user accesses a page of this website that contains such a plugin, the user’s browser establishes a direct connection to Facebook’s servers.

Facebook transmits the content of the plugin directly to the user’s browser, which integrates it into the website. The provider therefore has no influence over the scope of the data collected by Facebook through this plugin.

Based on the provider’s current knowledge, Facebook processes data as follows:

By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the provider’s website.

If the user is logged in to Facebook, Facebook can associate the visit with the user’s Facebook account.

If users interact with the plugins, for example by clicking the Like button or posting a comment, the corresponding information is transmitted directly from the user’s browser to Facebook and stored there.

Even if a user is not a member of Facebook, Facebook may still obtain and store the user’s IP address. According to Facebook, only an anonymised IP address is stored in Germany.

Users can find information about the purpose and scope of data collection, the further processing and use of data by Facebook, their related rights and the settings available to protect their privacy in Facebook’s privacy policy at:

https://www.facebook.com/about/privacy/

If a user is a Facebook member and does not want Facebook to collect data about them through the provider’s website and link it to the membership data stored by Facebook, the user must log out of Facebook before visiting the provider’s website.

It is also possible to block Facebook social plugins using browser add-ons, such as “Facebook Blocker”.

12.2 Use of X, Formerly Twitter

Our pages contain functions provided by the Twitter service. These functions are offered by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA.

By using Twitter and the “Retweet” function, the websites you visit are linked to your Twitter account and made known to other users. Data is also transmitted to Twitter in this process.

We point out that, as the provider of these pages, we have no knowledge of the content of the transmitted data or how it is used by Twitter.

Further information can be found in Twitter’s privacy policy at:

https://twitter.com/privacy

You can change your privacy settings on Twitter in your account settings at:

https://twitter.com/account/settings

13. External Links

To provide you with comprehensive information, our pages contain links to third-party websites. Where such links are not clearly identifiable, we indicate that they are external links.

We have no influence over the content or design of these websites. The provisions of our Privacy Policy therefore do not apply to them.

14. Rights of the Data Subject

If your personal data is processed, you are a “data subject” within the meaning of the GDPR and have the following rights against us as the controller.

You can exercise your rights by contacting our Data Protection Officer or the employees of our Service Centre and stating the nature of your request.

14.1 Right of Access

Every person affected by the processing of personal data has the right to obtain from the controller, at any time and free of charge, information about the personal data stored concerning them, including:

  • the purposes of processing;

  • the categories of data processed;

  • disclosure to third-party recipients;

  • the storage period;

  • the rights to restriction, rectification and erasure;

  • the right to lodge a complaint with supervisory authorities;

  • information about automated decision-making, known as profiling;

  • transfers to third countries or international organisations.

The data subject also has the right to receive a copy of this data.

You may request confirmation from the controller as to whether personal data concerning you is being processed by us.

14.2 Right to Rectification

Every person affected by the processing of personal data has the right to request the immediate rectification of inaccurate personal data concerning them.

Taking into account the purposes of the processing, the data subject also has the right to have incomplete personal data completed, including by providing a supplementary statement.

14.3 Right to Restriction of Processing

Every person affected by the processing of personal data has the right to request that the controller restrict processing if one of the conditions set out by the legislator in Article 18(1) GDPR is met.

Where the processing of personal data concerning you has been restricted, such data may, with the exception of storage, be processed only:

  • with your consent;

  • for the establishment, exercise or defence of legal claims;

  • for the protection of the rights of another natural or legal person;

  • for reasons of important public interest of the European Union or a Member State.

If processing has been restricted under the above conditions, the controller will inform you before the restriction is lifted.

14.4 Right to Erasure

Every person affected by the processing of personal data has the right to request that the controller erase personal data concerning them without undue delay where one of the grounds specified in Article 17(1) GDPR applies.

The right to erasure does not apply where processing is necessary:

  • for exercising the right to freedom of expression and information;

  • for compliance with a legal obligation that requires processing under European Union or Member State law to which the controller is subject;

  • for the performance of a task carried out in the public interest;

  • in the exercise of official authority vested in the controller;

  • for reasons of public interest in the area of public health pursuant to Article 9(2)(h) and (i) and Article 9(3) GDPR;

  • for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, insofar as the right referred to under section (a) is likely to render impossible or seriously impair the achievement of the objectives of that processing;

  • for the establishment, exercise or defence of legal claims.

14.5 Right to Data Portability

Every person affected by the processing of personal data has the right to receive personal data concerning them, which they have provided to a controller, in a structured, commonly used and machine-readable format.

They also have the right to transmit that data to another controller without hindrance from the controller to which the personal data was provided, where:

  • the processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR;

  • the processing is based on a contract pursuant to Article 6(1)(b) GDPR;

  • the processing is carried out by automated means.

14.6 Right to Object

Every person affected by the processing of personal data has the right, on grounds relating to their particular situation, to object at any time to the processing of personal data concerning them that is based on Article 6(1)(e) or (f) GDPR.

This also applies to profiling based on those provisions.

In the event of an objection, the company will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights and freedoms of the data subject, or unless the processing is required for the establishment, exercise or defence of legal claims.

Where the company processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for such marketing.

This also applies to profiling to the extent that it is related to such direct marketing.

If the data subject objects to processing for direct marketing purposes, the personal data will no longer be processed for those purposes.

14.7 Right to Withdraw Consent under Data Protection Law

Every person affected by the processing of personal data has the right to withdraw consent to the collection and use of data at any time, without stating reasons and with effect for the future.

The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

14.8 Right to Be Informed

If you have exercised your right to rectification, erasure or restriction of processing, we will inform all recipients to whom the personal data concerning you has been disclosed of the rectification, erasure or restriction of processing, unless this proves impossible or involves disproportionate effort.

You have the right to be informed about these recipients.

14.8 Questions / Right to Lodge a Complaint with a Supervisory Authority
